Terms of Use
In effect from 16 September 2026
These are the terms on which Crumpet Co Pty Ltd lets you use crmpt. They are written to be read. The italic line under each heading is a plain-English summary to help you find your way around; the numbered text beneath it is the agreement.
Our Privacy Policy explains how we handle your personal information and forms part of these Terms. Our Trust page names every service your data passes through.
1 Agreement
Using crmpt means you accept these Terms. You need to be 18 or older.
These Terms are between Crumpet Co Pty Ltd (ABN 83 656 267 015) (“crmpt”, “we”, “us”, “our”) and you. By downloading or using the crmpt app, creating an account, or otherwise engaging with crmptco.com (together, the “Application”), you agree to these Terms. If you do not agree, do not use the Application: delete your account, or otherwise stop accessing the app and the website.
You must be at least 18 years old to use crmpt.
2 Your permission to use the Application
You can use crmpt for yourself. You can't copy it, change it, or work around it.
Subject to your compliance with these Terms, crmpt grants you permission to use the Application, provided that:
- your use of the Application is solely for your personal, non-commercial, non-medical use;
- you will not duplicate, transfer, give access to, copy or distribute any part of the Application without crmpt's consent;
- you will not attempt to alter or modify the Application;
- you will not attempt to circumvent or otherwise interfere with the Application's ability to perform its functions; and
- you will comply with all applicable laws and regulations.
The Application may host information containing links to third-party websites or applications, including AI models, that are not owned or controlled by crmpt. crmpt has no control over, and no responsibility for, these third-party materials and products. By using the Application, you acknowledge and agree that crmpt shall not be responsible for any damages, claims or other liability arising from or related to your use of third-party products or materials.
3 Important: what crmpt is and is not
Please read this section carefully. It is the most important part of these Terms.
3.1 crmpt is not health care
crmpt is a journaling and self-reflection tool. It is not:
- a medical device;
- a mental health service, therapy, or counselling;
- a diagnostic, screening or treatment tool;
- a substitute for advice from a doctor, psychologist, psychiatrist or other qualified professional.
Using crmpt does not create a therapist–client or practitioner–patient relationship of any kind. When you use crmpt, you are creating notes, receiving Reflections and Patterns, journaling, or conversing with Aloud. While crmpt provides the Application for you to do those things, you are in control of what you share, disclose or otherwise do with the Application.
Never delay or avoid seeking professional help because of something you recorded in crmpt, or something a Reflection or Aloud said back to you. For help finding support, see the services listed in section 3.2.
3.2 crmpt is not a crisis service
crmpt cannot detect that you are in danger, cannot contact anyone on your behalf, and is not monitored by a person. crmpt is an Application and therefore cannot be responsible for knowing about, or engaging in, crisis situations. If you are in immediate danger, call 000.
If you are struggling, please reach out to a real person:
- Emergency — 000
- Lifeline — 13 11 14 · lifeline.org.au
- Beyond Blue — 1300 22 4636 · beyondblue.org.au
- 13YARN (First Nations) — 13 92 76
- Kids Helpline (ages 5–25) — 1800 55 1800
- Suicide Call Back Service — 1300 659 467
These are Australian services. If you are outside Australia, call your local emergency number, or find a service near you at findahelpline.com.
3.3 Reflections and Patterns are AI-generated
Reflections and Patterns are written by an AI model based on your recent entries. They are:
- generated automatically, without human review;
- capable of being inaccurate, incomplete, or reading your situation wrongly;
- not advice, not an assessment, and not a judgement about you.
Treat a Reflection as a prompt for your own thinking, not as a conclusion about your life. Do not rely on one to make an important decision about your health, relationships, finances or safety.
3.4 Aloud is an AI, not a person
Aloud is a conversation with a language model — a generative AI chatbot. It is not a person, not a counsellor, and not a friend. There is nobody on the other end.
Aloud can sound understanding, because that is how language models write. That impression is generated, not felt. Please hold that in mind, particularly if you find yourself relying on it.
Aloud can also be wrong. It can misread you, invent things, give poor suggestions, or say something that lands badly. It has no training, no duty of care, and no way to tell how you are actually doing.
We build safeguards into Aloud and test them, but we cannot control every response a language model generates, and we do not accept responsibility for its responses. Do not attempt to circumvent Aloud’s safety behaviour or our model instructions. If Aloud says something that seems wrong, harmful or out of place, please tell us at hello@crmptco.com. We read every report.
Do not use Aloud in place of professional help, and do not use it as your only support. If a conversation with Aloud is the closest thing you have to talking to someone, please also talk to someone real. Section 3.2 has the numbers.
3.5 Not a system of record
crmpt is not designed for storing information you cannot afford to lose. We back up our systems, but we do not guarantee that your entries will always be available. Keep your own copy of anything that matters to you.
4 Your account
Keep it secure, and keep it yours.
You are responsible for keeping your account secure and for activity that happens under it. Signing in uses a one-time code sent to your email address, so the security of that mailbox matters. Tell us at hello@crmptco.com if you think someone else has accessed your account.
Do not share your account, or create an account on someone else's behalf.
5 Your content
What you record is yours. The app is ours. We use your content only to run crmpt for you.
5.1 You own it
Any content you input to the Application — including your voice recordings, transcripts, Reflections and Aloud conversations — is yours. We do not claim ownership of it. You acknowledge and agree that crmpt owns all legal rights and interests in the Application itself, including its software, design, name and branding.
5.2 The permission you give us
You grant us a limited, non-exclusive licence to store, process, transcribe and transmit your content only to operate the Application for you, including sending it to the AI providers listed in our Privacy Policy and on our Trust page. This licence ends when the content, or your account, is deleted.
By accepting these Terms, you also consent to crmpt sharing non-personally identifying information, as described in the Privacy Policy, with third parties to help us understand usage patterns and to operate the Application.
We will never use your content to train AI models, sell it, publish it, or use it for advertising.
5.3 What you must not record
Do not use crmpt to record content that is unlawful, that infringes someone else's rights, or that contains another person's sensitive information without their knowledge. You are responsible for what you record.
6 Acceptable use
Don't break the law with it, and don't try to break it.
Do not:
- reverse engineer, decompile, or attempt to extract the source code of the app;
- use automated systems to access the Application;
- attempt to circumvent security, rate limits, or plan limits;
- resell or commercially redistribute the Application;
- use the Application to build a competing product;
- attempt to make Aloud produce harmful, unlawful or abusive content, or use prompts designed to bypass its safety behaviour or our model instructions;
- use the Application in a way that breaks any law.
7 Cost
crmpt is free while it's in early access.
crmpt is currently free to use while it is in early access. Some features and daily allowances vary by plan; during early access, plan access is granted by us rather than purchased.
If we introduce paid features, they will be sold through Apple's App Store as an in-app purchase or auto-renewing subscription, and we will update these Terms — including the terms for renewal, cancellation and refunds — before anything is charged.
8 Availability and changes
We'll keep it running, but features can change.
We may modify, suspend or discontinue features at any time. We will give reasonable notice before removing something significant. We may need to take the Application down for maintenance.
If we discontinue crmpt entirely, we will give you at least 30 days' notice and a way to take your entries with you.
9 Ending your use
You can leave whenever. We'll only end it for a real reason, and warn you first where we can.
You can stop using crmpt at any time. To delete your account and everything in it, email hello@crmptco.com from the email address on the account; the Privacy Policy explains what happens next.
We may suspend or terminate your account if you materially breach these Terms, or if we are required to by law. Where it is reasonable to do so, we will warn you first and give you a chance to fix the problem.
10 Warranty disclaimer
Legally required bluntness: crmpt is provided as it is. Your rights under Australian Consumer Law are untouched.
Subject to section 11, and to the fullest extent permitted by law: use of the Application is at your own risk. crmpt, its directors, employees and agents make no express warranties and disclaim all implied warranties in connection with the Application and your use of it. crmpt makes no warranties or representations about the accuracy, completeness or suitability of the Application’s content, and assumes no liability or responsibility for any (i) errors, mistakes or inaccuracies of content; (ii) unauthorised access to or use of our servers and/or any personal information or financial information stored there; (iii) interruption of transmission to or from the Application; (iv) viruses or malware which may be transmitted to or through the Application by any third party; or (v) errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Application. crmpt does not warrant, endorse, guarantee, or assume responsibility for any product or service offered by a third party through the Application.
11 Australian Consumer Law
Nothing here takes away the guarantees the law gives you.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Where we are permitted to limit our liability, our liability is limited to resupplying the service or paying the cost of having it resupplied.
12 Limitation of liability
There's a cap. It doesn't touch the rights the law gives you.
Subject to section 11, and to the maximum extent permitted by law:
- We provide the Application “as is”. We do not warrant that it will be uninterrupted or error-free, or that Reflections, Patterns or Aloud will be accurate or suitable for you.
- We are not liable for indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill.
- Our total aggregate liability for all claims in any 12-month period is limited to the greater of the amount you paid us in that period and AUD $100.
- We are not liable for decisions you make based on the content of a Reflection, a Pattern or an Aloud conversation, or for any outcome arising from you not seeking professional help.
13 Indemnity
If your use of crmpt causes a claim, it's on you — as far as the law allows.
To the extent permissible at law, you indemnify us against any and all claims, damages, losses, liabilities, costs or expenses arising from your use of the Application or your breach of these Terms, or from any claim that content produced by you caused damage to you or a third party.
14 Apple
Apple requires these lines. They mostly say Apple isn't involved.
These Terms are between you and crmpt, not Apple. Apple is not responsible for the Application or its content, has no obligation to provide support or maintenance, and is not responsible for addressing any claim you have relating to the Application, including product liability, legal compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You represent that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.
Questions, complaints or claims about the Application go to Crumpet Co Pty Ltd, hello@crmptco.com.
15 Changes to these Terms
If we change something material, you'll hear about it 14 days before.
We may update these Terms. For material changes, we will notify you in the app or by email at least 14 days before they take effect. Continuing to use crmpt after that means you accept the updated Terms. If you do not accept them, stop using crmpt and ask us to delete your account.
The current version is always at crmptco.com/terms.
